CUYAHOGA FALLS
12th DUI offense
AKRON: A 70-year-old Cuyahoga Falls man was convicted of his 12th drunken driving offense after a jury found him guilty Monday on two counts of operating a vehicle under the influence of alcohol, authorities said.
Edward A. South, of Highpoint Lane in the Falls, faces up to 10 years in prison at sentencing, prosecutors said.
Under Ohio law, he is subject to enhanced penalties as a repeat offender for having five or more prior OVI convictions in the last 20 years.
On Dec. 26, South crashed into a pole and walked away from the scene. He was driving on a suspended license at the time.
After Falls police tracked South to a family member’s home, he registered 0.087 percent on a blood-alcohol breath test, prosecutors said.
“He clearly has not learned his lesson and remains a danger to society as long as he has access to a vehicle on our roadways,” Summit County Prosecutor Sherri Bevan Walsh said in a news release.
South is scheduled to be sentenced at 1 p.m. May 23 by Common Pleas Judge Tammy O’Brien.

MEDINA
Doctor sentenced
MEDINA: A Medina chiropractor has been sentenced to 30 months in prison after pleading guilty to fraud in overbilling Medicare and insurance companies $1.8 million for equipment and treatments that were not medically necessary, federal authorities said.
Dr. John N. Heary, 39, pleaded guilty in October to seven counts of health-care fraud after being indicted on more than 50 charges.
Steven M. Dettelbach, U.S. Attorney for the Northern District of Ohio, said in a news release that Heary did business under his name and as two corporate entities — HealthSource of Medina and Medina Health & Wellness Center Inc., both located at 433 W. Liberty St.
Court records show Heary provided unneeded custom orthotics and expensive back braces without any demonstration of medical necessity or any pursuit of less costly alternatives. He also billed for supervised physical therapy sessions when patients were not supervised.
Insurers reimbursed Heary for more than $812,000, an amount he must repay in restitution, Dettelbach said.
